Kagan book - because it will never happen anyway is fine with law banning

Supreme Court nominee Elena Kagan has the gall to argue that a law so that State prohibition is OK book, because "it never would be applied" anyway. Is this woman really so naive? Is Kagan the best we can come up with for another life date on the most important Bank?
